1) Acceptance of these Terms

 

By accessing our website, creating an account, or purchasing products, you agree to these Terms & Conditions and all policies referenced here (Shipping Policy, Refund Policy, Privacy Policy). If you do not agree, please do not use the site.

 

 

2) Eligibility & account

 

You must be at least 18 to purchase. Keep your login secure and tell us immediately if you suspect unauthorized access. You are responsible for activity under your account.

 

 

3) Product information, availability & pricing

 

We aim to present accurate specs, images, and pricing. Minor variations may occur (e.g., supplier updates). We may correct errors, change or discontinue items, or limit quantities at any time.

 

 

4) Orders, payments & verification

 

All orders are offers to buy; we may accept or reject after screening (including fraud checks). We may request identity, address, or payment verification before shipment. For Shopping ads and checkout, we follow Google Merchant Center website-level and secure checkout expectations (contact details visible; SSL/TLS-protected checkout). 

 

 

5) Shipping & delivery estimates

 

Handling times, transit speed, service levels, and restrictions are stated in our Shipping Policy. If we cannot ship within the stated time (or, if none is stated, within 30 days), we will seek your consent to the delay or issue a prompt refund, consistent with the FTC’s Mail/Internet/Telephone Order Merchandise Rule. 

 

 

6) Risk of loss; title

 

Risk of loss passes to you upon delivery to the address you provided (subject to applicable law and any shipping insurance). Title passes upon our transfer to the carrier or as required by law.

 

 

7) Returns, refunds & exchanges

 

Return windows, condition requirements, restocking, and who pays return shipping are defined in our Refund Policy. Please obtain an RMA before sending anything back so we can route and process it correctly.

 

 

8) Safety, compliance & rider responsibilities

 

  • Consumer product rules. U.S. federal law treats low-speed e-bikes as consumer products subject to bicycle regulations at 16 CFR part 1512 (and related provisions). We select products with this framework in mind. 

  • Florida rules. In Florida, e-bikes and their operators generally have the same rights/duties as bicycles; the statute also addresses classification/labeling and prohibits tampering that changes a bike’s class unless relabeled. Riders must follow applicable traffic laws and any local trail/municipal rules. 

  • Batteries. Charge and store lithium-ion batteries safely (use approved chargers; don’t charge unattended; avoid heat/water exposure). Follow product instructions and local guidance.

 

 

9) Warranty; repairs; parts

 

We provide a limited warranty stated in our product pages or policy documents. Nothing in these Terms limits your rights under the Magnuson-Moss Warranty Act; the Act sets disclosure standards for written warranties and consumer remedies for breach. Use of non-OEM parts or modifications may affect coverage if they cause damage. 

 

 

10) Prohibited uses

 

You agree not to: (a) use the site for unlawful purposes; (b) interfere with site security or operations; (c) misrepresent identity, payment source, or affiliation; (d) resell or export products contrary to law; (e) upload malicious code; (f) use robots/scrapers that burden our infrastructure.

 

 

11) Intellectual property

 

All site content (text, graphics, logos, photos, video, code) is owned by MBX or its licensors and protected by IP laws. You may not copy, modify, distribute, or create derivative works without prior written consent, except for limited personal, non-commercial use.

 

 

12) User content (reviews, uploads)

 

If you submit reviews, images, or other content, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the site and our marketing. You represent that you own the content and it doesn’t infringe others’ rights or applicable law. We may moderate or remove content at our discretion.

 

 

13) Third-party services

 

Our site may link to or embed third-party services (payments, maps, tracking, financing, analytics). Those services are governed by their own terms and privacy policies; we are not responsible for their acts or omissions.

 

 

14) Disclaimers

 

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN WARRANTY, PRODUCTS AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES (EXPRESS OR IMPLIED), INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow limits on implied warranties; these limits may not apply to you.

 

 

15) Limitation of liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MBX AND ITS OWNERS/EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS; OR LOSS OF DATA ARISING FROM THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for claims relating to a purchase will not exceed the amount you paid for the product at issue. These limits do not apply where prohibited by law.

 

 

16) Indemnification

 

You agree to indemnify and hold MBX harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the site or products, or violation of law or third-party rights.

 

 

17) Governing law; venue

 

These Terms and any disputes are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, for any claim not subject to small-claims processes or another mandatory forum under applicable law.

 

 

18) Changes to these Terms

 

We may update these Terms to reflect operational, legal, or regulatory changes. We will post the new effective date when changes are made. Your continued use of the site after changes are posted constitutes acceptance.
